U.S. Department of Transportation Rules to Include Oral Fluid Testing in Regulated Industry Drug Testing Program

As of May 2, 2023, the U.S. Department of Transportation amended the regulated industry drug testing programing by passing its final ruling and including oral fluid testing as a method for employers. This additional methodology gives employers a choice of testing to combat cheating on urine tests and provide less-intrusive means of achieving safety goals.

In addition to this amendment, the rule amends the FAA, FMCSA, FRA, and FTA regulations to ensure consistency by adjusting and/or removing the word, “urine” and add references to oral fluid. The total list of changes and ongoing progress with this matter can be found at the included link.

SCAA members that attended the Annual Meeting in Jacksonville this year will remember the panel, led by Safety Committee Chair Leanne Stegman, that discussed marijuana in the workplace for our industry as well as potential testing methods. This ruling will directly affect our industry and how employers may choose to enact these safety measures moving forward to still achieve the goals of their programs.
